By using the botai.space website (the "Site") or the MajesticBot bot (the "Bot") on Discord, you (the "User") agree to be bound by these Terms of Use, the Discord Terms of Service, and all applicable laws and regulations. You are solely responsible for compliance with local laws applicable to you. If you do not agree to any of these terms, you are prohibited from using the Site and the Bot. The materials contained on the Site and Bot are protected by applicable copyright and trademark laws.

- BotAI ("We"): The company providing the services of Software, Website, Bot.
- User (hereinafter - "You"): A person who uses Software, the Site, the Bot.
- Third Party Services: Services and resources provided by third parties integrated with or utilized by the Site and Bot, including but not limited to: Emoji.gg, Google Inc (including Google Analytics and other Google services), Discord Inc, OpenAI Inc & OpenAI Global, Cloudflare and others.
- Content: Any materials, information, data, text, images, audio, video and other resources available on the Site and in the Bot.

Restrictions on use
By using Bot or the Site, you are prohibited from:
- Copy, modify, distribute or create derivative works based on the Content for commercial or non-commercial purposes without the express written permission of BotAI.
- Remove, modify or obscure any copyright, trademark or other proprietary notices contained in the Content.
- Create unlicensed copies of the Bot or the Site.
- Use the Bot or the Site in any manner that violates these Terms of Use, Discord's Terms of Service or any applicable laws or regulations.
- Take any action to circumvent, breach or deactivate any technological protections utilized by the Site or the Bot.
Cancellation of the Agreement
If you violate these Terms of Use, your right to use the Site and the Bot will automatically terminate and we may take such other legal action as we deem appropriate.

The materials on the Site and in the Bot are provided "as is" and "as available" without warranties of any kind, express or implied, including, but not limited to, warranties of fitness for a particular purpose, warranties of non-infringement, or warranties of accuracy, reliability, or availability of the Content.
Responsibility for Discord settings
BotAI and its representatives are not responsible for any negative consequences that may occur on your Discord server or DM as a result of inattention, negligence or misconfiguration of Bot functionality by your server administration or by you in the DM. All Bot settings are provided "as is" and their use is solely at your own risk.
Limitation of liability
In no event shall BotAI or its representatives be liable for any direct, indirect, incidental, special or consequential damages (including, but not limited to, damages for loss of data or profits, business interruption) arising out of the use of or inability to use the Site, Bot or Content, even if BotAI has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of liability for incidental or consequential damages, our liability is limited to the maximum extent permitted by law.
Accuracy of information
BotAI does not warrant the accuracy, completeness or currency of the Content available on the Site and in the Bot. The Content may contain technical, typographical or photographic errors. We may make changes to the Content at any time without notice, but we make no commitment to update the Content.

Any dispute arising out of or relating to these Terms of Use shall be brought in the courts located in the State of California, and you consent to the exclusive jurisdiction of those courts.
